Privacy Declaration of Job Applicants

This ‘Privacy Declaration of Job Applicants’ (hereinafter referred to as ‘the Privacy Declaration’) regulates the processing of your Personal Data by the Controller responsible for the processing, being one of the following companies:

American Clothing Associates NV, American Clothing Distribution NV, American Clothing Associates BV, ACA Germany GmbH, ACA France SARL, RW Outlet Company SARL and American Clothing Retail SA  (hereinafter all referred to as  ‘River Woods’).

River Woods attaches great importance to processing of your Personal Data in a manner that complies with the existing laws and regulations for the protection of your privacy.

Read this Privacy Declaration with care, as it contains your rights and obligations in relation to River Woods.

River Woods reserves the right to make changes to this Privacy Declaration. This Privacy Declaration may be regularly revised or updated and you are advised to check this Privacy Declaration regularly so that you remain aware of such changes.

By using the River Woods website, you should also read the General Privacy Statement so that you are aware of how River Woods handles your information when you visit the website. 

 

Article 1 – General

1.1. By completing and/or sending the application form or e-mail, you (hereinafter referred to as ‘the Applicant’) accept that the Personal Data will be processed by River Woods and will be included in our database.

1.2. With this Privacy Declaration, River Woods also complies with European Regulation 2016/679 of 27 April 2016 concerning the protection of personal data (hereinafter referred to as the General Data Protection Regulation (‘GDPR’)).

 

Article 2 – Personal data

2.1. Personal Data that you provide to us:

  • contact details of the Applicant (name and address details, e-mail address, gender, language)
  • training of the Applicant (education, training courses etc.)
  • employment record (former employers, references etc.)
  • family situation.               
     

2.2. River Woods gathers and processes the Personal Data of Applicants:

  • Directly or by means of forms and/or attached CVs via the website of River Woods, with URL www.riverwoods.net.
  • River Woods also gathers and processes Personal Data of Applicants by means of personal contacts, telephone calls and/or e-mail.
     

Article 3 – Objectives of the processing

3.1. General objectives:

We will treat the Personal Data in confidence and use these only for the application process at River Woods.

 

3.2. Transfer to third parties:

We shall not provide any information to third parties unless we are required to do so by law.

 

3.3. Internal transfer:

The Applicant declares that he/she consents to the further processing of the Personal Data within River Woods and the companies affiliated to it in a group. 

 

3.4 External transfer

Where necessary, River Woods will transfer the Applicant’s personal data to its social partners. This will be the case if the Applicant is offered an employment contract.

 

Article 4 – Duration of the processing

River Woods stores the Applicant’s Personal Data during the recruitment and selection procedure.

The Personal Data are also stored for a period of two years after the recruitment and selection procedure.

Local legislation (concerning the storage of these data) is always consulted and complied with in this case.

After the end of this term, the Personal Data are erased from the River Woods system in full.               


Article 5 – Your rights

5.1. Right of access:

The Applicant has the right to view his or her Personal Data stored by River Woods at any time, free of charge. The Applicant’s right of access relates to an overview of the personal data gathered by River Woods through the collection of the data submitted by the Applicant himself. However, the right of access does not grant the Applicant the right to view any internal notices drawn up by the authorised employees or appointed persons within River Woods.

5.2. Right to rectification, erasure and restriction:

The Applicant has a free choice of whether to notify River Woods of his/her Personal Data. The Applicant also always has the right to request us to rectify, supplement or erase the Personal Data. The Applicant recognises that if he/she refuses to provide Personal Data or submits a request to erase Personal Data, certain products and services cannot be supplied.

The Applicant may also request that the processing of his/her Personal Data be restricted to the personal data necessary to identity the applicant and qualify him/her for a particular job.

 

5.3. Right to object:

The Applicant also has a right to object to the processing of his/her personal data for serious and legitimate reasons.

 

5.4. Right of free data transfer:

The Applicant has the right to receive his/her Personal Data that are processed by River Woods in a structured, (digital), customary and legible form and/or to transfer these data to other responsible parties.

 

5.5. Right to withdraw consent:

In as far as the processing is based on the Applicant’s prior consent, he or she has the right to withdraw such consent.

 

5.6. Exercising your rights:

The Applicant may exercise his or her rights by means of a written request (with a copy of the front of your identity card) via:

5.7. Right to lodge a complaint:

 

Applicants have the right to lodge a complaint with the competent supervisory authority. Please note that the leading supervisory authority for River Woods is the following:

Action before the civil courts remains possible after this.

If the Applicant suffers damage as a result of the processing of his or her Personal Data, he/she can file a claim for compensation for damage.

 

Article 6 – Security and confidentiality

6.1. River Woods has developed security measures that are adjusted on a technical and organisational level in order to prevent the erasure, loss, forgery, alteration, unauthorised access to or accidental disclosure to third parties of the Personal Data gathered, as well as all other prohibited processing of these data.

 

Article 7 – Access by third parties

7.1. In order to be able to process the Personal Data, River Woods grants its employees access to the Personal Data to the extent that this is necessary for one of the purposes of processing described above.

7.2. River Woods guarantees a similar level of protection by making contractual obligations equivalent to this Privacy Declaration enforceable against these employees and appointed persons.
